Since this is Crash Analysis, let's focus on how to avoid the crash rather than who is at fault.

.jmoney, you described the situation pretty well. What would you differently if you had the opportunity to do this over again?

For legal help, post this in leo section. This section goes over what you did, and how you along with others may avoid this in the future.

Erratic drivers in the radar = Slow the heck down and give them the radius of a nuke about to go off.

first: never trust another on the rd.
second: you should not have tried to fill in his space till he was completely out of the lane. squeezing in has cause many a crash.

sounds like you were close to him did you have three seconds or more between the two of you?

were you in a hurry to get someplace?

cages have been know to snap back into the lane they are in the process of getting out of due to another cage doing something in the "new" lane.
AKA: two cages trying to occupy the same space in one lane at the same time.
both were moving in to said from adjacent lanes. (lanes 1 and 3 both moving into lane 2).

parked cage moving into shoulder lane?

cage pulling out of driveway/garage/etc partly blocking the shoulder lane?

legal advice i can not give. call a lawyer.
