"So I've had a chance to watch the crash video in more detail and I've come to a rather disturbing theory on what may have really happened. My theory is admittedly based on some stereotypes that I have on the type of guy that drives a decade plus old Lexus - they tend to be gang-banger wannabes - at least in my area. How do I know the SC400 that hit Gawernator is at least 10 years old? Because many years ago I was shopping for a used SC400 and I limited my search to the 2006 model year and newer because they came with a cool new LED taillight setup beginning with the '06 model year. The one that hit Gawernator was therefore an '02-'05 model.

I noted that the gentleman was also wearing baggy jeans and an oversized black hat - more evidence of the stereotype. I also noticed that the very first thing he did when he got out of his car was not run to Gawernator's aid - instead, he first checked to see how much damage his car had suffered. Then he took his sweet old time to slowly walk over to Gawernator - exactly what one would expect the stereotype to do.

So here's my theory. I noticed that the SC400's rear view mirror was visible to Gawernator for AT LEAST 4 seconds, probably much more, before the impact. This means Gawernator's approaching headlight was visible in the dude's mirror for the same time as Gawernator approached - the car basically has no blind spot since it's a convertible! My theory is that the stereotype took umbrage to the fact that Gawernator was able to coolly tool along while stereotype had to sit in traffic so he decided to engage in some unprovoked road rage to teach Gawerator a lesson - not necessarily hit him but at least scare him. I've personally witnessed this type of behavior from cagers on many occasions here in Florida where lane splitting is admittedly illegal but where it's commonly done in traffic jams. I see this "lane crowding to teach the lane splitter a lesson" behavior most frequently engaged in by folks who fit the stereotype referenced above along with the stereotypes that drive lifted pickups.

So that's my theory and I'm sticking to it.

Yes, that's right. While it's debatable if dude used his signal, I think I do see ONE blink at the 22 second mark - which was AFTER the dude had already commenced his "lane crowding to teach the lane splitter a lesson" mission and was done at PRECISELY the best time to scare the lane splitter and hence teach him a lesson. If he was genuinely trying to change lanes he would have signaled for a few seconds BEFORE starting to change lanes, instead he waited until the very last second when Gawernator was already on the guy's ass and would serve no purpose other than to scare Gawernator (who didn't even see it because he was probably gazing 100 feet ahead as we're taught to do on a bike). I have PERSONALLY WITNESSED the usage of turn signals by road ragers who "lane crowd to teach the lane splitter a lesson". During bike week and Biketoberfest, when central Florida is overrun with bikers, I've seen it used against bikers who aren't even lane splitting but are either speeding, stunting, or both, in their own lane. During one bike week I remember witnessing a guy fly by me on I-4 doing a wheelie at about 90 mph in a 65 and seeing a pickup truck way ahead decide to change lanes for no apparent reason other than to try to mess with the biker.

I read the thread and am not at all confused as to the cause of the collision. The insurance companies and CHP appear to have reinforced your "position" on this, but they're doing you a disservice. You need to change your approach to lane splitting. Specifically, your closing speed is too high. Also, when cars are staggered, you're better off moving away from the car next to you as you pass, to give yourself a little more reactionary gap in case they try to change lanes.

I couldn't care less about a pound of flesh. This crash after a few months of lane-splitting isn't a good record. If what the video showed is typical of your approach, it will happen again unless you change.
