transporting a handgun

nobody must have actually read my entire post.

i guess my real question would in regards to the ammo. is how im doing it now ^^^ legal?



I have a GTI..so since it's a hatchback it should be the same deal as a pickup. I put my pistol in the case I bought it in, with a cable lock on it. That goes in the hatch. I put the ammo in any container since it doesn't have to be locked AFAIK. I just use whatever..either in an unlocked ammo can and that goes on the floor in front of the passenger seat

or in a ziplock bag if I'm making a quick trip to the range so I can collect the casings back in the same bag.

As long as the amm doesn't touch your gun it doesn't matter. Ammo is not regulated, a firearm and it's loaded/unloaded status are. You can have piles of loose ammo rolling around your car for all we care :)
 
If I'm going to the range (the only time I have a gun in the car), I usually carry it in a rug, in a range bag, with a trigger lock. The mags are unloaded.

My car is a hatchback with no trunk, but I keep the range bag in the back ... I was under the impression that it was okay as long as the gun, and ammo, were out of immediate reach of the driver.

Does all this mean I should really have the gun in a safe to be legal?
 
If it's a concealable firearm (handgun), it needs to be in a locked container if it's within the passenger compartment of a vehicle. Your hatchback, if accessable without exiting the vehicle, is a passenger compartment.

A long-gun does not need to be in a locked container when inside the passenger compartment.

In neither case shall the firearm be loaded or ammo be touching it in anyway, shape, or form.
 
What if the hatch has a cover? can can only be removed when opening the hatch itself?

and isnt this all silly if it needs to be in a locked case anyway while transporting to/from the car?

One post in this thread says that the magazine can be loaded and in the same locked container as the firearm, just not IN the firearm.

I've also heard however, that if the mazine is touching the firearm it can be considered loaded.

How do you have it in the same locked container as the firearm and be certain a LEO won't consider your firearm to be loaded?
 
Honestly ask any leo, since they don't have to abide by this nonsense, if they transport their handgun locked where you can't get to it? :laughing

I asked a LEO this very question a few months back. He had absolutely no idea. That was confidence-inspiring to say the least... :|

And also "unfairly" in any state and manner. While you have a chance at defending yourself in a potential carjacking, the average law abiding citizen does not... :nerd

The reasons we're allowed to carry w/o the same restrictions goes a bit beyond "unfairness" ....
 
Your main reason versus mine for self protection only differs in that you're a sworn officer. I know most off duty LEOs are carrying concealed to "protect" themselves. But really how is that different from a normal citizen especially inside a vehicle? Don't you think since most criminals know it's illegal to carry a gun in a car. The carjacking success rate just went through the roof?

Ironically, all LEOs approach a vehicle standing on the other side of that logic. They approach it as if its armed even though we have these laws that are meant to protect LEOs ONLY. See how effective this law is at preventing crime? :laughing

How about this, I'll sign up and take all the defensive pistol tactics gunsite offers beyond even what LEOs are trained in. So then should I be denied my natural right to protect myself or carry concealed even when I know what I am doing? I'll take the chance of a misdemeanor vs. running into a thug anyday especially in Oakland.

I would support ccw's for backgrounded, trained, and psychologically evaluated citizens... then you could conceal it in your vehicle as well

Irks me a bit that despite military training, despite shooting since I was 15 or so (and I'm a pretty damn good shot if I do say so myself =P), despite keeping up on this shooting regularly (at least every other weekend), despite having held a CCW for the last 3 1/2 years in TX, and having carried a weapon every day for the last 5 years........now that I've moved back to CA I'm disarmed. And people shit bricks if you OC. Stories I've seen on forums about OC in CA, including run ins with LEOs who didn't fully know the wording on the laws or anything...makes OC a very unattractive option. I'll be applying for a CCW anyway...though I highly doubt I'll get it in this area :(
